The Americans with Disabilities Act Amendments Act (ADAAA) is federal civil rights law originally passed by Congress in 1990 (as the Americans with Disabilities Act-ADA) and protects individuals with disabilities from discrimination in the workplace, as well as school and other settings. The ADA was amended in 2008 and became effective January 1, 2009.
A person is disabled if he or she:
- has a physical or mental impairment which substantially limits one or more activities;
- has a record of such and impairment;
- is regarded as having such an impairment.
The ADAAA requires that employers provide “reasonable accommodation” to otherwise qualified disabled workers, so that they are able to perform the essential functions of their jobs.
For further information, the policy and guidelines are located at the following Administrative Rules:
- 4.0101.01: Employment of Individuals Under the Americans With Disabilities Act, As Amended
- 4.0101.01.1: Employment of Individuals Under the Americans With Disabilities Act, As Amended (G/P)
